Last week, superior court judge Benjamin Alford ruled that a North Carolina law prohibiting cohabitation violated a Pender County woman's constitutional rights. Today, a community in Macon County will vote on whether to allow businesses to sell beer and liquor by the drink. Throughout our history, laws have been written that either reflect or shape our collectively morality, but when should the law lead social change or follow social custom? Host Frank Stasio puts that question to: Jedediah Purdy, assistant professor of law at Duke University; Kermit L. Hall, president of the University at Albany, State University of New York and professor of history and legal history; and Beth Posner, domestic violence attorney with Legal Aid of North Carolina. Listener Call-In.
